As outlined in the final rule, “the financial requirements and treatment limitations applicable to mental health or substance use disorder benefits must be ‘no more restrictive’ than those applied to substantially all medical/surgical benefits.”

For families, this means fewer insurance hurdles when seeking ABA services. “Health plans have violated MHPAEA for more than 15 years, and this final rule is a step in the right direction to protect patients and hold health plans accountable,” said Bruce Scott, MD, president of the American Medical Association, in a statement to the Healthcare Financial Management Association.

At the same time, Medicaid billing is facing increased scrutiny. Recent audits have uncovered issues such as incomplete documentation and billing for unauthorized services, prompting states to tighten oversight.
